Terms and Conditions
By making your reservation and payment, you confirm that you have read and understood the details of the accommodation and that you agree to these Terms and Conditions.
WHO WE ARE
We are Mysilversands Limited, a company registered in England and Wales (Company Number 5933016). You can verify our company details at the UK Government Companies House website.
We do not own the villas or services you book through us. We are authorised by the villa owners or service providers (“Owners/Operators”) to make them available to you.
Accommodation-only services cover villa rentals and related accommodation services offered on our website, www.mysilversands.com, where no linked travel arrangements (such as flights, car hire, or tours) form part of your booking.
PARTIES TO THIS AGREEMENT
This Agreement is between Mysilversands Limited and you, the Party Leader making the booking. You must be over 18 years old.
You agree to provide a copy of official identification (for example, the photo page of your passport or a driver’s licence) promptly after submitting the Reservation Form. We will communicate only with the Party Leader.
By booking, you confirm that you accept these Terms on behalf of yourself and every member of your party.
This Agreement, together with the booking confirmation and the villa details shown on our website, forms the entire agreement between us.
COMMUNICATIONS
We will send your Booking Confirmation (which includes a copy of these Terms) to you by email. This Confirmation, together with these Terms, forms your binding contract.
You are responsible for keeping your party informed and for checking the Confirmation carefully to ensure it matches what you intended to book.
Please notify us immediately of any issues with the villa or its staff during your stay so that we may address them. While we welcome feedback and complaints after departure, we may not be able to resolve them. Neither we nor the villa owner can accept responsibility or pay compensation for such matters.
We reserve the right to decline a booking at our discretion, in which case we will refund all money paid.
MAKING A BOOKING AND PAYMENT
Bookings are made through our website. If you need help completing the Reservation Form, we can assist. Prices on our site are inclusive of Jamaican Government taxes and fees at the time of booking.
We do not charge booking or payment card fees for payments made through our website, although your own bank or card provider may apply charges that are outside our control.
A non-refundable deposit (usually 20% of the total accommodation cost) secures your booking. If you book within 31 days of arrival, full payment is required.
Balances are due 30 days before arrival. Failure to pay may result in cancellation without refund. If we cancel a booking at our discretion, we will refund you in full.
REFUNDS
Mysilversands holds guest payments in line with good practice and only disburses funds to owners after your stay is complete. This ensures that if a refund is due, you will always be paid.
CANCELLATION POLICY
If you cancel all or part of your booking, you must notify us in writing as soon as possible. We will try to rebook the cancelled nights to another guest.
If we rebook them, we will refund you for those nights less an administrative fee of US$100. If we cannot rebook them, no refund is given.
No refund is available for unused portions of your stay. We strongly recommend travel insurance with cancellation cover.
CHANGING YOUR BOOKING
You may request changes to your booking up to 72 hours before the day of arrival. You must send your request in writing. A change takes effect only when we confirm it in writing.
After that point, we will try our best to accommodate changes, but we cannot guarantee that a change will be possible. An administration fee of $100 per change applies.
If the change reduces the number of nights, the reduced nights are treated as a cancellation under the Cancellation Policy. If the change increases the price, you must pay the difference in order for the change to be confirmed.
PROVIDING INFORMATION
You must ensure that all information you give is correct and tell us promptly if anything changes. By providing other people’s personal data, you confirm that they consent to you sharing their data with us.
If you are visiting from abroad, you must comply with all passport, visa and other entry requirements. Your travel documents must be valid and in good condition.
Please pass on all important safety and travel information that we provide to everyone in your party. If you have reduced mobility or other needs, please tell us before you book.
PERSONS PERMITTED AT THE ACCOMMODATION
Your booking covers the number of guests stated on the Reservation Form. Only you and your party may use the villa.
Entry is restricted to villa staff and Mysilversands staff or representatives (“Permitted Persons”) unless we give prior written permission. Vendors and other unauthorised persons must not be invited into the villa.
If you admit unauthorised persons, you will be responsible for any resulting loss or damage. This is a serious breach of contract. We may cancel your booking immediately, require you to leave the villa, and no refund will be given for any unused portion of your stay. Once terminated in this way, we will have no further obligations to provide accommodation or services under this Agreement.
PRICE GUARANTEE
The price at which you book is guaranteed. If any price on your confirmation, our website or our systems is an obvious mistake, a booking based on that price will not be valid; we may cancel it and refund you unless you choose to pay the correct price.
If a new government tax or levy is introduced after booking, we may pass this on to you. If you do not wish to pay the additional cost, either party may cancel the booking for a full refund.
CHANGES BY US
Occasionally, we may need to alter or cancel a booking. We will notify you promptly and offer either a full refund or, if available, alternative accommodation of similar standard (with a refund if lower-priced).
Examples of reasons beyond our control include maintenance or safety issues at the villa, war or threat of war, civil disturbance, terrorist activity and its consequences, industrial disputes, natural or nuclear disasters, fire, health risks, severe weather, sanctions or other governmental action, and similar events.
OTHER PERMITTED CHANGES
You may substitute a named guest at no charge if you notify us in advance. You may request to extend your stay if the villa is available.
If you reduce your stay, the cancelled nights are treated under the Cancellation Policy.
WHAT IS AND IS NOT INCLUDED
Rates include Jamaican taxes, staff salaries, water and electricity. Villas are furnished and equipped with linens, bath towels, dishes, utensils, soaps and tissue paper.
Rates do not include insurance, flights, airport charges, car rental, transportation, airport transfers (unless a return transfer to and from Montego Bay is explicitly included), baggage handling, staff gratuities, telephone charges, food, beverages, liquor, personal items or dry cleaning.
Where Mysilversands provides airport transfers, the allowance is two suitcases per passenger and, while we try to help where possible, we are not obliged to transfer additional or unconventional luggage unless agreed in advance.
USE OF WATER SPORTS EQUIPMENT
Some villas include access to water sports equipment. Availability varies by villa and will be shown on the villa page and on our website.
Before use, you must obtain permission from on-site staff, sign the liability and safety waiver, and follow all safety instructions, including using the buoyancy aids provided and supervising children appropriately.
You agree that you use the equipment at your own risk and accept the normal risks involved in water sports. The property owners and Mysilversands Limited do not accept responsibility for any injury, loss or damage you may incur in connection with your use of the equipment, except where the law prevents exclusion (including liability for death or personal injury caused by negligence, for fraud, or for your statutory rights).
Failure to sign the waiver or comply with safety instructions may result in termination of your stay without refund.
DURING YOUR STAY
Check-in / Check-out – Times are stated in your Booking Confirmation. Strict observance is required. Late departures or early arrivals without permission incur penalties (US$100 for up to 60 minutes, or one night’s rent if over an hour).
Bedrooms – If you booked fewer bedrooms than the villa offers, please tell us in advance which rooms you intend to use.
Security / Damage Deposit – Some villas require a refundable deposit, as show on our website. Deposits must be paid before arrival. If unpaid, entry may be refused and payments forfeited. Deposits are refunded within 7 days of departure if no losses or damages are found. We will provide an itemised statement of any deductions on request.
Breakages and Losses – You are responsible for any loss or damage beyond normal wear and tear. Charges may be deducted from your deposit or billed to you for prompt payment.
Pets – Pets are not permitted without prior written approval. Special rules apply if permission is given. Breach of this condition may result in immediate termination without refund.
Maintenance & Utilities – Repairs will be arranged as soon as possible after notification. Interruptions to utilities are outside our control and are not compensated.
Television & Wi-Fi – No refunds are made for interruptions or failure of television or Wi-Fi services provided at the villa.
Life in the Tropics – Warm weather and seasonal rains are normal in Jamaica. Keep doors and windows closed when using air-conditioning. Despite pest control, small insects may be present. Ants may appear if food is left out; these are harmless, though their sudden appearance may catch you by surprise if you have not experienced this before.
GUESTS’ BEHAVIOUR
Smoking and vaping are not permitted inside the villa.
You are responsible for the proper conduct of yourself and your party. In cases of serious misconduct or disruptive behaviour, we may terminate your stay immediately. No refund will be given and we will have no further obligations to you.
Disruptive behaviour includes threatening or abusive behaviour, damaging property, making excessive noise, disturbing other guests or staff, or putting anyone at risk.
If you or your party deliberately or negligently cause any loss or damage to accommodation, property or persons, you agree to compensate us for the loss, including legal costs.
LIABILITY
We are not responsible in any way for loss, damage, injury or expense arising in connection with the provision of any service or the rental of the villa or equipment, or arising from the actions of any airline, vessel, ground carrier, travel agency, tour operator, or their agents.
We are not responsible for loss, damage, delay, harm or expense caused by weather, acts of terrorism, acts of God, labour unrest, monetary crisis, theft, quarantine, civil commotion, arrest or restraint by government, war, or other conditions outside our control.
If we have knowingly misrepresented the villa, we will either move you to suitable accommodation or cancel the booking for a full refund at your choice.
Our maximum liability to you is limited to the total price you paid to us.

MODIFICATION OF TERMS
These Terms may be varied at any time at our discretion. The Terms in effect at the time of your booking will apply to your stay. If we wish to apply revised Terms to your booking, you may choose to accept them or cancel for a full refund.
JURISDICTION
This Agreement is governed by the laws of England and Wales, and you submit to the exclusive jurisdiction of those courts. You may choose the law and courts of Scotland or Northern Ireland if you live there.
